BLAZEPOD CUSTOMER SURVEY OFFICIAL TERMS

NO PURCHASE IS NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
These terms and conditions (“Terms”) are a legally binding and enforceable agreement between Play Coyotta Ltd. operating under the brand name BlazePod (“BlazePod”, “we”, “our”, or “us”), and participants who participate, enter or win in the Customer Survey and Sweepstakes (respectively, “Participant” or “you”, “Survey”, and “Sweepstakes”).
BY PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE TO BE FULLY UNCONDITIONALLY BOUND BY THESE TERMS, AND YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS SET FORTH HEREIN. IN ADDITION, YOU AGREE TO ACCEPT ANY DECISIONS OF BLAZEPOD, AS FINAL AND BINDING WITH REGARDS TO ANY OF THE TERMS HEREIN. THE SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS.
CAUTION: ANY ATTEMPT BY A USER OR PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, BLAZEPOD RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT BLAZEPOD’S SOLE DISCRETION) WILL RESULT IN DISQUALIFIYING THE WINNER AND PRIZE.
1. ELIGIBILITY.
THE SWEEPSTAKES ARE GOVERNED EXCLUSIVELY BY THE LAWS OF THE UNITED STATES, AND YOU ARE NOT AUTHORIZED TO PARTICIPATE IN THE SWEEPSTAKES IF YOU ARE NOT LOCATED WITHIN THE FIFTY (50) UNITED STATES, THE DISTRICT OF COLUMBIA OR IN PUERTO RICO. VOID OUTSIDE THE GEOGRAPHIC ELIGIBILITY LISTED HEREIN AND WHERE PROHIBITED. YOU MUST BE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY (NINETEEN (19) IN ALABAMA AND NEBRASKA, AND TWENTY-ONE (21) IN MISSISSIPPI). You must be an active user or purchasing customer of BlazePod to participate in the Sweepstakes. Further, employees, directors and officers of BlazePod, each of their respective affiliates, and any supplier involved in the development, administration, production, fulfillment of this Sweepstakes, including their immediate families or any other individuals living in the same households, are not eligible to enter or win a prize. Each Participant by participating in the Sweepstakes agrees to be bound by these Terms, which are final and binding in all matters related to this Sweepstakes.
BlazePod has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to discqulify Participants for any reason, including, but not limited to; multiple entries from the same Participant from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.
2. SWEEPSTAKES PERIOD.
The Sweepstakes starts on 10th of January, 2024 at 10:00 AM EST and ends on 21st of January, 2024 at 11:59:59 PM EST (“Sweepstakes Period”).
3. HOW TO PARTICIPATE AND ENTER THE SWEEPSTAKES.
BlazePod will send a Survey invite for potential eligible customers. To be eligible to win a prize, the Survey form must be answered and duly completed in its entirety by submitting answers to all the Survey questions, as specified in such Survey. The Survey must be completed and submitted within the Sweepstakes Period. Upon submitting the Survey, the Participant shall be required to provide certain contact and identification information.
Each Participant may participate in the Sweepstakes only once. Entries submitted by anyone other than the Participant, or multiple entries by the same Participant, are void. In case of dispute as to the identity of any Participant, entry will be declared made by the registered name and address on such entry. Any potential prize winner may be requested to provide BlazePod with proof of identity, or any other required details to ensure its eligibility under these Terms.
If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the BlazePod sole discretion.
4. PRIZE.
Prize Winners (no more than five (5) Participants) will receive an email informing them about their win, and following that will receive one eGift Card to Amazon.com with a tow hundreds US dollars ($200) retail value (“Prize”). Actual/appraised value may differ at the time of Prize award. The specifics of the prize shall be solely determined by BlazePod. No cash or other prize substitution permitted except at BlazePod’s discretion. The Prize is non-refundable and non-transferable. Any and all Prize related expenses, including without limitation any and all federal, state, or local taxes shall be the sole responsibility of the winner. No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by winners is permitted. The prize is awarded “as is” and without any warranty, except as required by law. In no event will more than the number of prizes stated in these Official Rules be awarded.
Redemption of the Prize shall be further subject to the separate and independent terms set by Amazon, not under BlazePod control, nor reasonability.
5. WINNERS SELECTION AND ODDS.
A random drawing will be held on 21st of January 2024 from among all eligible Participants submitted to the Sweepstake. The drawing will be conducted by BlazePod, including by automatic means (e.g., through the use of a random selection computer function. Five (5) Prize Winners shall be selected. The odds of winning depend upon the total number of eligible entries received. The drawing process and the Prize Winners selection by BlazePod shall be final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible Participants received.
6. WINNING NOTIFICATION AND CLEARANCE.
The winner will be contacted by BlazePod via email to the email address entered in registration within seven (7) days following the winner selection. The winner is required to send back a confirmation to BlazePod’s email confirming its winning and claiming the Prize. BlazePod shall have no be liable in the event the winning notification email was sent to the spam, junk e-mail or otherwise to an incorrect or non-functioning email address provided by the Participant. If the selected winner cannot be contacted, is ineligible, fails to claim the Prize by sending a replay email 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternate winner selected or revoked upon BlazePod sole discretion and per applicable law.
7. LIMITATION OF LIABILITY.
TO THE FULLEST EXTENT PERMITTED UNDER LAW, BLAZEPOD, TOGETHER WITH ITS AFFILIATES, OFFICERS, EMPLOYEES AND DIRECTORS, WILL NOT BE HELD RESPONSIBLE FOR ANY liability, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, caused from (i) participation in the Sweepstake or use of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software to claim the prize; (iii) the unavailability or inaccessibility of any transmissions or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of Participants. Proof of submission of the Survey will not be deemed to be proof of receipt by BlazePod.
8. PRIVACY AND PUBLICATION.
By entering the Sweepstakes, you grant us permission to use your personal information in accordance with our privacy policy located: https://www.blazepod.com/pages/privacy-policy. By participating in the Sweepstakes, Participants hereby acknowledge that they have read and accepted the privacy policy.
BY ENTERING THE SWEEPSTAKES YOU AGREE TO RECEIVE EMAIL NEWSLETTERS PERIODICALLY FROM BLAZEPOD. YOU CAN OPT-OUT OF RECEIVING THIS COMMUNICATION AT ANY TIME BY CLICKING THE UNSUBSCRIBE LINK IN THE NEWSLETTER.
Except where prohibited by law, Participants irrevocably grant to BlazePod, its affiliates, agents and licensees, the royalty-free right and permission to unconditionally reproduce, store, transmit, publish, display, use or reuse their name and prize information, as well as any other information or materials arising out of participation in the Sweepstakes for advertising, promotional, commercial, publicity and/or any other purposes (without limitation), in any and all media now or hereafter known, in any language, throughout the world, and in any manner without further review, notice, approval, consideration or compensation to the Participant. Unless prohibited by law, Participants waive any rights of privacy, rights of publicity, intellectual property rights, and other rights that may preclude BlazePod from using or disclosing its name or information in any manner and for any purpose related to the Sweepstakes.
9. AMENDMENTS AND TERMINATION.
BlazePod has the right, in its sole discretion, to modify these Terms (including without limitation by adjusting any of the dates and/or timeframes stipulated herein) and to cancel, modify or suspend this Sweepstakes at any time in its discretion, including without limitation if a virus, bug, technical problem, entrant fraud or misconduct or other cause beyond the control of the Sponsor corrupts the administration, integrity, security or proper operation of the Sweepstakes or if for any other reason Sponsor is not able to conduct the Sweepstakes as planned (including without limitation in the event the Sweepstakes is interfered with by any fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or of public enemy, communications failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, federal, state or local law, order or regulation or court order) or in the event of any change to the terms governing the application or interpretation of such terms. In the event of termination of the Sweepstakes, a random drawing will be conducted to award the prize from among all eligible Participants submitted prior to the time of termination.
10. DISPUTES AND GOVERNING LAW.
These Terms are governed exclusively by the Laws of the State of Israel, without regards to its conflict of laws principles, and any dispute arising from the Sweepstakes shall be brought exclusively before the competent courts of Tel-Aviv, Israel. Any cause of action you might have relating to the Sweepstake or these Terms is limited in time to one (1) year from the arising incident and will be permanently barred afterwards.
